ARTICLE 1.- RIGHT OF WITHDRAWAL. Suppliers who market goods and services remotely, through websites or similar formats, must have in plain sight, in a prominent place and on the first access, a link called “WITHDRAWAL BUTTON”, through which the consumer can request the revocation of the acceptance of the product purchased or the service contracted, in the terms of Articles 34 of Law No. 24,240 and its amendments, and 1,110 of the Civil and Commercial Code of the Nation.
When using the CANCELLATION BUTTON, the provider may not require the consumer to register beforehand or complete any other additional procedures.
ARTICLE 2.- SPECIAL MODALITIES FOR ITS EXERCISE. The provisions of the previous article shall govern based on the considerations listed below, in the following cases:
a) When it comes to the purchase of tickets for shows, sporting or artistic events, the period of TEN (10) consecutive days to exercise the right of withdrawal will be counted from the date on which the tickets or their corresponding proof of payment are delivered to the consumer, whichever occurs first, regardless of the date of the event.
b) When it comes to the purchase of tickets for shows, sporting or artistic events, in order to exercise the right of withdrawal within the period of TEN (10) calendar days, the consumer must send the communication or notification provided to the supplier at least TWENTY-FOUR (24) hours before the performance of the show or sporting or artistic event in question.
c) The same situation as that provided for in the previous paragraph will apply when it comes to exercising the right of withdrawal with respect to contracts made for tourism purposes with a specific date, such as hotel or property rentals, car rentals, booking excursions or medium and long distance transportation, among others.
ARTICLE 3.- EXEMPTIONS. The provisions of Article 1 of this regulation shall not apply in the following cases:
a) In the cases established in Article 1.116 of the Civil and Commercial Code of the Nation, except as otherwise agreed.
b) When the consumer has actually used or consumed the contracted product or service and, subsequently, intends to exercise the right of withdrawal within the period provided for in Article 34 of Law No. 24,240 and its amendments.
c) In the event that the consumer, whether a natural or legal person, intends to exercise the right of withdrawal regarding the acquisition or contracting of products or services for resale purposes and/or are integrated into production, transformation, marketing or provision processes to third parties when they are related to said processes, whether generically or specifically, as established by Article 2 of Decree No. 1,798 of October 13, 1994.
d) When it comes to the acquisition of perishable products.
